Modern E Manners Waiver and Release of Liability Form

I hereby give my permission for my child(ren) to participate in the Modern e Manners program.

I hereby affirm that my child(ren) has/have no conditions that would make it unsafe for him/her/them to participate in Modern E Manners.

Medical Consent: I understand that the Modern E Manners/Health Specialties LLC will make every effort to contact me in the case of an emergency.

By signing this Waiver and Release of Liability, with full appreciation of the risk involved, on my own behalf and on behalf of my child(ren), I hereby voluntarily release and forever discharge Modern E Manners/Health Specialties LLC and Dr. Erica Hamburger, its trustees, officers, employees, agents, insurers and contractors from any and all legal or financial responsibility for any personal injury, disability, illness, damage, medical expense or death, arising from or related to my child(ren)’s participation in Modern E Manners. I agree, for myself and my child(ren), not to make any type of legal or equitable claim on Modern E Manners/Health Specialties LLC/Dr. Erica Hamburger, or any of its trustees, officers, employees, agents, insurers or contractors with respect to any injury I or my child(ren) may suffer, whether or not it arises through the negligence, omission, default or other action of anyone affiliated with the program, including other participants. I further agree that if any such claim is made, I will indemnify and defend the program with respect to any such claim, injury or damage.

Allergies
By registering, you understand and agree that Dr. Erica Hamburger/Modern E Manners/Health Specialties LLC and its employees, agents, owners, and assigns are not responsible for any allergy related incidents, which may result from participation in this course. You are responsible for informing Modern E Manners/Dr. Erica Hamburger of any allergies from which your child suffers. You understand and acknowledge that this course includes training on dining etiquette, which could expose your child to any and all food or other allergens to which your child may be exposed intentionally or unintentionally. You hereby waive any liability and hold Modern E Manners/Health Specialties LLC and its employees, agents, owners, and assigns harmless from any and all claims for damages with regard to allergies which may result from your child's participation in the cotillion courses hosted by this business including any liability which results from the negligence of the company, its employees, agents or assigns.

Photo Release
By registering, you understand photos and videos may be taken of your child and may then be used for online and/or print marketing purposes. If this is not ok with you, please email Dr. Erica Hamburger directly with your request prior to the start of the program.

Refunds
Refunds are available for our Cotillion program and Parenting program until June1st, 2025. A $50 fee will be retained from the refunded tuition to cover administrative costs.
After June 1st, tuition is non-refundable.

High School Etiquette Dinners and British High Teas are non-refundable.

Dismissal
I acknowledge that Modern E Manners/Health Specialties LLC reserves the right to dismiss any participant from its courses at any time should the child engage in behaviors which threaten the safety of other participants, which are unacceptable to or disrupt the enjoyment of the owners, agents, employees or guests of the Company. This will be done at the Company’s sole discretion and may be done at any time with or without notice to you. I further acknowledge that should my child be dismissed for failure to comply with the rules and regulations of the Company or should my child engage in the above referenced behaviors, I will not be entitled to a refund of my child’s tuition.

General Liability
We will do our utmost to care for your child while he or she is with us. However, accidents and injuries are possible, though unlikely. By registering your child for Modern E Manners programs you understand and acknowledge that you are hereby waiving any and all claims for damages to your child or your child’s property against the Company Modern E Manners/Health Specialties LLC its employees, agents, owners, guests, or assigns, including, but not limited to, damages for injuries to your child which result from the negligence of the Company, its employees, agents, owners, guests, or assigns. The Company is not liable to you for any damages to personal property or to the persons involved in the courses and activities in which the Company engages and offers to your child as a participant. You hereby acknowledge that your child will be participating in activities which may, however unlikely, cause injury and do waive any claims for liability which you might attempt to bring against the Company, its guests, agents, employees, or assigns. Further, you will indemnify and hold harmless the Company from any damages which may result from your child’s actions which could potentially lead to injury or damage to another participant in this class should your child’s actions be found to be intentionally or recklessly harmful to others.

PHONES Students are asked not to have a phone with them during any of our classes/programs. We are not responsible for lost or stolen phones.
